General Conditions Le Caribou
1. General
1.1. Scope
These General Terms are an integral part of the contract that you enter into, from online booking on the Le Caribou website,for the rental of rooms, apartments or chalets and all related goods and services. They are applicable between the tenant client (hereinafter the Tenant) and Le Caribou (hereafter the Owner), as owner and operator, for all stays in one of the accommodations Le Caribou (Dahu apartment, Bouquetin apartment and Chalet Orignal) from 1 night booked.
1.2. Applicable law and competent jurisdiction
This contract is exclusively governed by Swiss material law. The parties agree that Villars-sur-Ollon, Switzerland, will be the competent jurisdiction.
1.3. Changing terms and conditions
Terms and conditions can be changed at any time. These can be viewed on the website Le Caribou and the Tenant undertakes to consult them, in order to keep abreast of any changes, these changes or updates are applicable to all users as soon as they are published.
The Tenant’s General Terms do not apply.
If a provision of the contract or these terms and conditions is null, invalid or unenforceable, the remaining part of the contract or these terms and conditions, respectively, remains unchanged.
2. Contract conclusion
The booking request made on the Le Caribou website becomes contractual once the Tenant has paid the full payment.
Sending the electronic booking confirmation to the Tenant (here the Contract) is considered an acceptance, as the rights and obligations of the contract and the present terms and conditions become effective.
2.1. Payment
All payments must be made in Swiss Franc (CHF) by net bank transfer of any bank charges.
2.2. Settlement means
The accepted means of payment are: Visa, MasterCard, PayPal
2.3. Payment not received
The Owner reserves the right to consider the booking as cancelled if the balance has not been paid before the expected date of the stay.
3. Price
Prices are specified in the contract and are shown in Swiss francs (CHF) including VAT. The residence tax is included in the room price.
Prices published on the website are communicated as an indication and may vary depending on the booking period.
You can refer to the description of the apartments and cottages to see what the price includes.
4. Customer obligations
4.1. Use of the premises
The Tenant must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.
The Tenant must leave the apartment or cottage when he leaves in a correct condition, as he found it at the beginning of the stay. In the absence of a “correct state” at the time of departure, additional charges may be charged.
The Tenant is obliged to use the furniture and objects furnishing the rented property for the purpose for which it is intended and in the places where they are located. It is forbidden to transport them out of rented premises.
The Tenant undertakes to use the wifi internet connection made available to him in a reasonable and compliant manner. It ensures that the machines it plugs into this network do not compromise its security (software and antivirus updated in particular). He answers for any damages related to non-compliance with these points.
In the event of loss, breakdown or deterioration, the Tenant must inform the Owner as soon as possible.
4.2. responsibility
The Tenant is liable to the Owner for any loss and damage of any kind caused by himself or by a third party directly or indirectly, for which he is responsible. The same applies if the dwelling cannot be handed over to the next tenant as a result of depredations.
If the Tenant is the victim of injury or if he is not satisfied with the services offered by the Owner, he must in any case inform Le Caribou immediately. Otherwise, it is assumed that the Tenant waives his rights.
All claims against Le Caribou usually expire three months after the day of departure, as there is no mandatory legal provision for a longer period of time.
4.3. Insurance
The Tenant is responsible for all damages a occurring by his or her or a third party and undertakes to personally take out all necessary insurance for his stay, in particular liability insurance. Accordingly, the Owner disclaims any liability for the action that his insurance company could take against the Tenant in the event of a disaster.
4.4. Length of stay
A fixed-term contract is signed between the Tenant and the Owner. Under no circumstances will the Tenant be entitled to any right to remain in the premises at the end of the stay.
4.5. Ability
The contract is set for a maximum capacity defined at the time of booking by the Tenant. If the number of tenants exceeds the capacity of the accommodate, the Owner may refuse the additional persons. Any modification or breach of contract will be considered at the initiative of the Tenant.
In this case, the rent is due subject to any other claim or claim for compensation.
4.6. Animals
Animals are not allowed in the dwellings or on the estate.
4.7. Other
The Tenant will not be able to sublet or cede his rights to this contract without the Express consent of the Owner.
The commercial use of the premises Le Caribou by the Tenant is not allowed.
5. Le Caribou Bonds
5.1. Making the premises available
The Caribou undertakes to make available to the Tenant the rooms, apartments or cottages rented in accordance with the descriptive condition, to provide the corresponding goods and services and to respect the obligations resulting from this contract.
If damage is found at the time of handing over the rented thing or if the inventory is incomplete, the Tenant (s) are required to notify the Owner immediately. Failing that, the rented thing is deemed to have been restored in perfect condition.
5.2. Additional services
If the Tenant wishes services and/or goods that are not offered by the Owner, the Owner acts only as an intermediary to provide these services. These services and/or goods are not subject to these General Conditions and The Caribou cannot be held responsible for these services.
5.3. Internet
A wifi internet connection is available to the Tenant. The Caribou strives to maintain the best possible availability for its internet connection but disclaims any responsibility in the event of interruption or decrease in service performance.
5.4. responsibility
The Owner cannot be held responsible for accidents occurring to persons registered on the booking form or persons in the apartment or cottage unless it is directly due to his own negligence.
The owner cannot be held responsible for the loss, infringement or delay due to unintended circumstances on his part such as (non-exhaustive list): natural events (storm, etc.), natural disasters (floods, etc.), fire or accident, civil risk, measures taken at the government or local level, etc.
The owner cannot be held responsible for the non-operation of electrical or mechanical appliances such as TV, Internet, boiler, water heater, etc. and for the non-functioning of communal services such as water and electricity. In the event of malfunction of one of the devices, the Tenant should notify the Owner immediately who will carry out the necessary repairs.
The Owner cannot be held responsible for noise or disturbance caused by external sources or that is not in his control.
The Owner cannot be held responsible for the loss, breakage or theft of objects inside or outside the cottage.
5.5. Other
Although all descriptions on the website have been verified, errors may have occurred. If this is the case, no liability is accepted.
Photos and plans of apartments and cottages posted on the website are offered as an indication. Minor differences between photos and website descriptions with the actual apartment or cottage may exist.
Information about the Villars-sur-Ollon region, the ski resort and activities has been given in good faith but its accuracy cannot be guaranteed.
6. Arrival and departure
6.1. Arrival
Apartments and chalets are available from 16:00 (Check-In).
In the event of a late or delayed arrival, the Tenant must notify the Owner immediately of the change of schedule brought to his knowledge
6.2. Start
Apartments and cottages must be vacated by 11:00 (Check-Out)
In the event of a premature departure, no refund will be made.
Early arrival or late departure can be agreed with Le Caribou, subject to availability. Additional charges may be charged for early check-in and/or late departure.
7. Cancellation
7.1. By the Tenant
The Tenant (s) may (may) terminate the contract at any time under the following conditions:
- Up to 31 days before arrival: CHF 100.- management fee.
- 30 to 10 days before arrival: 50 of the amount of the stay.
- 9 to 0 days before arrival/non-presentation: the entire amount of the stay.
In case of early restitution of the rented thing, the entire rent remains due.
This contract applies as a recognition of debt within the meaning of section 82 LP, for the amount of the lease as well as for all amounts owed by the Tenant under the provisions contained in it.
7.2. By the Owner
The Caribou may terminate the contract with immediate effect, without further notification, if the contract was entered into by giving false or misleading information about the tenant’s person, the purpose or content of a stay, or if the rented accommodation is used for non-contract purposes.
An extraordinary termination can be made with immediate effect during the lease in the following cases:
– Non-payment of the rental on time
– Non-compliance with these terms and conditions
– Non-compliance with the maximum number of tenants allowed
– Police complaint
– In case of theft, fraud, breach of trust or other serious offences
The Owner may terminate the contract with a valid reason in the event of force majeure, any other event beyond his control or will and which make it impossible to properly execute the contract, or if he has good reason to assume that the use of the services by the Tenant may compromise the safety or reputation of the Caribou.
In the very unlikely case of cancellation by the landlord, due to unintended circumstances on his part, the total amount will be returned to the tenant. The Tenant is not entitled to any damages and interest in the event of justified termination of the contract by Le Caribou.
If the chosen apartment or cottage category is not available for a reason not mentioned above, the Owner may propose to the Tenant another category of apartment/chalet. If the Tenant does not agree with the new apartment/chalet category, both parties are free to terminate the contract, without any other contractual or legal obligation. The Tenant is not de facto entitled to an apartment/chalet in a higher category.
